Child Law and Adoption

Whether you are a parent, grandparent, or carer for a child, there are a multitude of different issues that can arise about that child’s care.  Those might include:

  • With whom a child should live
  • With whom a child should have contact, and how, where and when that contact should take place
  • Whether the child should be able to move to a new area or country
  • Where and how a child should be educated
  • How that child should be financially supported

Scots law in relation to children broadly takes a common sense approach, and it is always preferable that parents can agree their own arrangements in relation to their children.  Where that is not possible, Courts can make a wide variety of orders, based on what is in the best interests of the child.  We can help you understand your rights and obligations, and can advise and assist you in reaching agreement about any child-related issues, and take quick and effective action through the Courts, where necessary.

In reaching any decision about a child, the law requires the views of the child to be taken into account where it is appropriate to do so.  We can help ensure that a child’s voice is heard, and their wishes are properly taken into account.

We have substantial experience in dealing with all types of adoption work, whether the application is by a step-parent or an unrelated party, and can help you understand the process.
