Executries

When someone dies, their ‘estate’ (all their assets and belongings) has to be distributed properly. 

How the estate is distributed depends on whether or not there is a Will, and the size and extent of the assets involved.

Where there is a Will appointing an Executor, we can assist the Executor with the procedures required to properly administer the estate.  Where there is no Will we can assist with the appointment of a family member as Executor.

During the executry administration we will;

  1. investigate the assets and belongings owned at date of death and obtain valuations where applicable
  2. prepare an Inventory of all assets for the executors approval
  3. arrange for payment of any inheritance tax due
  4. obtain Confirmation from the sheriff court (this is known as Probate in England)
  5. ingather all the assets and pay any liabilities due
  6. calculate any amounts due by way of Legal Rights to family members
  7. distribute the estate according to the Will or the law of intestate succession in Scotland where there is no valid Will
  8. prepare a detailed account for the executors approval

We understand that this can be a very traumatic time for everyone concerned and will try to deal with matters as sympathetically and expediently as possible.
