Collaborative law
Parties must both instruct solicitors who have undergone collaborative law training. Parties and their solicitors agree that court proceedings will not be raised and commit to full disclosure and a ‘solution seeking’ approach.

Negotiation
This allows parties to determine for themselves, with the help of their solicitors, the best solution. The process involves an exchange of information with a view to finding terms acceptable to both parties.

Litigation
When parties cannot reach agreement themselves or with the help of their solicitors, they can ask the court to decide matters. This is likely to be the most expensive method but in some cases, it is the only option.

Mediation
This is a voluntary process where the parties, with the assistance of a neutral mediator, try to reach agreement. It is a less formal process than court and is also generally quicker and less expensive.

Arbitration
This allows for assembling relevant information and exploring possibilities in an investigative way. The process is managed by an arbiter who then makes a decision.

For employees, it is important to note there are strict time limits for making a claim to an Employment Tribunal; you must make your complaint to the tribunal within three months of the effective date of termination (where practicable). A dismissal will be deemed fair if the employer can show that the reason for dismissal was related to the employee’s conduct, capability or qualifications for the job; because the employee’s role had become redundant; a statutory duty or restriction prohibited the employment continuing; or where there was another substantial reason justifying dismissal. The employer must also show that they acted reasonably; for example, by following the correct disciplinary process.  We can assist employers looking for guidance on correct procedure, to ensure you are working within the law every step of the way.

In most circumstances, an employee must have at least two year's continuous service before he or she can make a complaint to an Employment Tribunal unless the employee believes he has been discriminated against, or has been dismissed due to maternity.
